Trademark Policy

Open University Malaysia takes great care in the development and protection of its trademarks and reserves all rights of ownership of its trademarks. These trademarks include the above representations and logos and other designs and logos owned and used by Open University Malaysia, as well as Open University Malaysia products and service names. The Open University Malaysia trademarks are important corporate assets, and it is required that they be used only in accordance with this Trademark Policy.

Trademark Usage
“Fair use” of the Open University Malaysia trademarks, that is, use by a third party without express permission or license, is limited to text-only references to Open University Malaysia trademarks such as products and services names, and excludes Open University Malaysia logos. In such references, the user must be truthful, must not disparage Open University Malaysia, and must not mislead the public. The user must be clear and accurate as to the nature of the relationship between Open University Malaysia and the user or the user’s company, its products, and its services. When making fair use of Open University Malaysia trademarks, the user must properly mark and attribute them. The first reference in text to the Open University Malaysia trademark must be followed by the proper trademark symbol. The proper symbol for registered trademarks is ® .Whenever an Open University Malaysia trademark is used, acknowledgement of Open University Malaysia’s ownership must be provided in the following manner:

[insert permissible mark] [is a/are] registered trademark[s] or trademark[s] of Open University Malaysia.”

In order to preserve its reputation and protect its trademarks, Open University Malaysia diligently guards against infringement and dilution of its trademarks. Use of Open University Malaysia trademarks together with counterfeit products or with Open University Malaysia products obtained from sources other than authorised Open University Malaysia providers, will not be tolerated.

The risk of unauthorised use of Open University Malaysia trademarks can be minimised by adhering to the following guidelines:

  • Do not use the Open University Malaysia corporate logo or any other Open University Malaysia logo without the written permission of Open University Malaysia.
  • Do not alter, adapt or modify any Open University Malaysia trademark.
  • Do not use any Open University Malaysia trademark in a manner that is likely to cause confusion about the origin of any product, service, program, material or other offerings.
  • Do not use any Open University Malaysia trademark or name in a manner that is likely to give the impression or otherwise imply an affiliation or association between the user, the user’s products or services and Open University Malaysia or any of its products, services, programs, materials or other offerings, unless expressly permitted in writing by Open University Malaysia.
  • Do not use any Open University Malaysia trademark or name as or as part of a company, product, service or program name.
  • Do not use any Open University Malaysia trademark or name in a manner that is likely to dilute, defame, disparage, or harm the reputation of Open University Malaysia.
  • Do not use, register or seek to register any trademark, name or designation that is confusingly similar to the Open University Malaysia name or any Open University Malaysia trademark.
  • Do not copy or imitate any Open University Malaysia type style, logo, product packaging or the look, design, or overall commercial impression of any Open University Malaysia website, blog or other materials.
  • Do not register or use any domain name that incorporates any Open University Malaysia mark or name.
  • Do not use the Open University Malaysia trademark name for a product or service as a noun or in the plural form.
  • Always use the proper spelling for Open University Malaysia trademarks.
